MISSOURI FIRM PAYS $1,575 TO SETTLE SEED CASE
WASHINGTON, Jan. 13, 2005 –– The U.S. Department of Agriculture today
announced that a Mountain Grove, Mo., seed company has paid USDA $1,575 to
settle an alleged violation of the Federal Seed Act.
The company, Farmers Ag Center, settled the case in agreement with
officials from USDA's Agricultural Marketing Service. The company neither
admitted nor denied the charges.
The case resolved by the settlement involved three shipments of tall
fescue seed made to Indiana, Georgia and Tennessee. The shipments to
Tennessee and Indiana were reshipped in interstate commerce by other
firms.
The alleged violations, while not the same for all shipments, were:
- false labeling as to presence of noxious-weed seed;
- false labeling of seed purity; and
- failure to properly label the shipper's name and address or an
approved code designation.
AMS administers the act with the help of state seed officials. Seed
regulatory officials in Kentucky and Georgia cooperated with AMS in making
the investigations. The Federal Seed Act is a truth-in-labeling law
designed to protect farmers and consumers who buy seed.
